The Constitutional Court has ruled that Section (6)1 of the South African Citizenship Act 88 of 1995 be scrapped. It dictates that South Africans lose their citizenship if they voluntarily acquire another nationality, unless they apply for and obtain retention from the Minister of Home Affairs. Delivering the judgment, Justice Steven Majiedt said the Act should be scrapped from the date of its promulgation. The Supreme Court of Appeal had previously ruled that Section 6(1)a was unconstitutional, but relied on the Constitutional Court to ratify its decision.
